1About These Terms
These Terms of Service ("Terms") govern your access to and use of Website.ge ("we," "us," "our," or "the platform"), a domain name marketplace operated in Georgia. They constitute a legally binding agreement between you and the platform operator. If you are using the platform on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.
2Eligibility & Account Registration
You must be at least 18 years old and have full legal capacity to enter into contracts under Georgian law to register an account. Registration requires your full name, a valid email address, and a Georgian mobile phone number. Phone verification via SMS is mandatory before your account becomes active.
You are responsible for keeping your login credentials confidential and for all activity carried out under your account. Notify us immediately at contact@website.ge if you suspect unauthorised access. You may not register more than one account or transfer your account to another person without our written consent.
3The Platform
Website.ge is an online marketplace where registered users ("sellers") can list domain names for sale, and other registered users ("buyers") can purchase them. The same user may act as both buyer and seller. We facilitate transactions by holding buyer funds in an internal balance system and releasing payment to sellers upon confirmed transaction completion.
We are not a domain registrar and do not perform domain transfers ourselves. Buyers and sellers are responsible for arranging the actual domain transfer following a completed transaction. Website.ge is not party to the domain name registration agreement between a registrant and any registrar.
4Domain Listings
To list a domain for sale you must: (a) own the domain or have the right to sell it; (b) verify ownership by either adding a TXT DNS record provided by us or pointing the domain's nameservers to our servers; (c) provide accurate information including asking price (or indicate "by agreement"), domain age, expiry date, categories, and a description. Listings are reviewed and approved by our administrators before becoming publicly visible.
We may reject or remove any listing at our discretion, including if it is inaccurate, infringes third-party rights, or violates these Terms or applicable law. Approved domains may receive a domain authority score (DA/PA) fetched from the Moz API — this data is informational only and not a warranty of quality.
5Buying a Domain — Buy Now
Clicking "Buy Now" on a listing creates a purchase request at the listed price. The request is sent to the seller for approval; it is not an automatic confirmed sale. Once the seller approves, the agreed price is held from your balance. If your balance is insufficient, the shortfall must be topped up before the order can be completed.
After a sale is confirmed, the seller is required to transfer the domain to you in a timely manner. Website.ge will not release the seller's payout until the transaction is confirmed as complete by our administrators. We do not guarantee that any listed domain can be successfully transferred to a new registrant or that the buyer will obtain any associated content, trademarks, or historical traffic.
6Selling a Domain
By listing a domain you confirm you have full authority to sell it and that it is free of any encumbrances, legal disputes, or third-party claims. Upon accepting a buyer's order you are obligated to cooperate in the domain transfer promptly and in good faith.
After a successful transfer is confirmed, your payout (sale price less commission) will be credited to your Website.ge balance. Failure to transfer a sold domain in a timely manner, or any fraudulent listing activity, may result in order cancellation, refund to the buyer, and permanent suspension of your account.
7Price Offers
Where a seller enables the offer feature on their listing, buyers may submit custom price offers. The seller may accept, reject, or counter an offer. An offer accepted by the seller creates a binding obligation on both parties to complete the transaction at the agreed price. Sellers may choose to display accepted offer amounts publicly on the domain's listing page.
8Installment Purchases
Certain listings may offer an installment payment option, allowing the purchase price to be paid in scheduled instalments. Installment terms must be agreed between buyer and seller and approved by our administrators. Each instalment is debited from the buyer's balance on its due date. Failure to maintain sufficient balance for a scheduled payment, or repeated missed payments, may result in cancellation of the installment agreement. In the event of cancellation, payments already made may be non-refundable at the seller's discretion, subject to the terms agreed at the time the installment plan was created.
9Account Balance
Your Website.ge balance is held in trust by us and may be used to fund domain purchases. To top up your balance, make a bank transfer to our company IBAN including your unique reference ID in the payment description so we can identify your payment. Top-ups are processed manually by our administrators and may take 1–2 business days to be credited.
You may request withdrawal of your available balance at any time. Withdrawals are processed manually and subject to identity verification. We do not pay interest on account balances. Balances may not be transferred between accounts. We reserve the right to freeze a balance that is under dispute or where fraud is suspected.
10Commissions & Fees
Website.ge charges a commission on completed domain sales. The applicable commission rate is deducted from the seller's payout at the time of transaction and is displayed during the transaction process. There is no fee to list a domain or to submit an offer. We reserve the right to update our commission rates; changes will be notified in advance and will not apply to transactions already in progress.
11Prohibited Conduct
You may not: list domains you do not own or have no right to sell; provide false or misleading information in a listing; attempt to conduct domain transactions outside the platform to avoid commissions; manipulate traffic statistics or domain authority data; harass or send unsolicited messages to other users; create multiple accounts to circumvent a ban or restriction; use automated scripts, bots, or scrapers against the platform; or engage in any activity that violates Georgian law or applicable international law.
12Intellectual Property
The Website.ge platform, including its design, code, logo, and original content, is the intellectual property of its operators. You retain ownership of any content you submit to the platform (such as domain descriptions and images), but you grant us a non-exclusive, royalty-free, worldwide licence to display and reproduce that content in connection with the service.
13Disclaimer & Limitation of Liability
The platform is provided on an "as is" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service, that any listed domain will sell, or the accuracy of third-party data such as domain authority scores or WHOIS records.
To the maximum extent permitted by Georgian law, our total aggregate liability to you for any claim arising from these Terms or use of the platform is limited to the total commission fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or loss-of-profit damages.
14Account Suspension & Termination
We may suspend or permanently ban your account if we reasonably determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the platform. We will make reasonable efforts to inform you of the reason. You may request voluntary account closure at any time by contacting us at contact@website.ge. Closure does not extinguish any outstanding obligations.
15Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the platform after any changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the platform and may request account closure.
16Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Georgia. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Georgia. We encourage you to contact us first at contact@website.ge to attempt to resolve any issue informally before initiating legal proceedings.
